Terms of Service

Last updated: 5 October 2026

1. Agreement

These terms apply when you use codemistry.in, create an account, or hire Codemistry ("we", "us") for a project. By using the website or our services you agree to them. If you do not agree, please do not use the website. For a project, the written quotation you accept forms part of our agreement; if it differs from these terms, the quotation applies.

2. Our services

Codemistry is a web and app development agency. We build websites, Android and iOS apps and custom CRM software, provide website maintenance and redesigns, and offer AI features as an add-on. The exact scope, deliverables, timeline and price of each project are set out in its written quotation.

3. Website estimates and quotations

  • Prices shown on the website and in the online quotation builder are estimates to help you plan. They are not a binding offer.
  • After discussing your requirements, we send a written quotation with the final price, scope and timeline. Work starts only after you accept it and pay the advance.
  • Quotations are valid for the period stated on them. Work outside the agreed scope is quoted separately before we start it.

4. Payment terms

  • Unless your quotation says otherwise, projects are paid in three parts: 10% advance to start, 40% mid-way after about half the work is done, and 50% on completion before final handover.
  • Monthly services (such as website management) are billed in advance for each month.
  • All prices are in Indian Rupees (INR). Applicable taxes are shown separately on the invoice.
  • If a payment is more than 7 days late, we may pause work until it is received; timelines move accordingly.
  • Third-party costs, such as domains, hosting, paid plugins, app store fees, SMS or payment-gateway charges, are paid by the client unless the quotation includes them.
  • Refunds, if any, depend on the work completed at the time of cancellation (see section 10).

5. Your account

  • You must give accurate details and verify your mobile number. You can also sign in with Google.
  • Keep your password and devices secure. You are responsible for activity on your account; tell us at once if you suspect misuse.
  • We may suspend accounts that are used for fraud, spam or abuse.

6. Your responsibilities

  • Give clear requirements and timely feedback and approvals.
  • Supply the content you are responsible for (text, images, logos, product data) on time.
  • Make sure you have the right to use any content, brand or material you give us.
  • Delays in feedback, content or payments may change the delivery date.

7. Ownership of the work

Once the project is paid in full, you own the custom code, designs and content we created for your project, and we hand over the source code and access details. Open-source libraries, frameworks and third-party tools remain under their own licences. Until full payment, ownership stays with us. We may show the finished project in our portfolio unless you ask us not to.

8. Support and maintenance

We fix bugs in the work we delivered for the support period stated in your quotation. New features, content changes, and problems caused by third-party services, hosting, or changes made by others are not covered, and can be handled under a maintenance plan or a separate quote.

9. Confidentiality

We keep your business information, data and ideas confidential and share them only with team members who work on your project. We ask you to keep our pricing, proposals and internal methods confidential too. How we handle personal data is explained in our Privacy Policy.

10. Cancellation

Either side may end a project with 14 days' written notice (email is fine). You pay for the work completed up to that date, and we hand over that work once all due payments are received. Amounts already paid for work that has been done are not refundable.

11. Acceptable use of the website

  • Do not send false information, spam or harmful content through our forms or chat.
  • Do not try to break into, overload, scrape or disrupt the website, the admin area or other users' accounts.
  • Website content, text and graphics belong to Codemistry and may not be copied without permission.

12. Limitation of liability

We build every project with care, but we cannot guarantee that a website or app will be free of every error or always available, or that it will reach a particular search ranking or sales result. To the extent the law allows, our total liability for any claim about a project is limited to the amount you paid us for that project, and we are not liable for indirect losses such as lost profit or data.

13. Changes to these terms

We may update these terms from time to time. The latest version is always on this page with the date at the top. The terms in force when you accepted your quotation apply to that project.

14. Governing law

These terms are governed by the laws of India. We will always try to resolve disagreements by talking first; if that fails, the courts of West Bengal, India have jurisdiction.
